Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Toby Stapleton, carrying on business as MyPip ("MyPip", "we", "us", "our"), a sole proprietor based in British Columbia, Canada. They govern your use of the MyPip website at mypip.io and the MyPip application at my.mypip.io (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1. What the Service does

MyPip helps you find and reach potential customers. You give us your website. We work out who is likely to buy from you, find real people who fit across public sources where they already post, research them, score how well they match you, and prepare suggested messages for reaching each one. Every morning we deliver a short brief of your best people to a channel you connect.

You send every message yourself. MyPip does not send outreach on your behalf and is not an email or messaging sender. It prepares suggestions and delivers them to you; the decision to contact anyone, and the act of contacting them, is yours. Features may change over time.

In these Terms, "Contacts" means information about potential customers that the Service surfaces for you from public sources and third-party providers.

2. Eligibility and accounts

  • You must be at least 18 and able to form a binding contract.
  • You must give accurate information and keep your account credentials secure.
  • You are responsible for all activity under your account.
  • You may sign in using email, Google, or Discord. If you use a third-party sign-in, your use of that provider is also governed by their terms.

3. Early access

The Service is offered on an early-access basis while we build it out. This means some features are new, may change, or may be withdrawn, and the Service may occasionally be unavailable. We will tell you about material changes, but you should not rely on any specific feature remaining available.

4. Subscriptions, billing, and refunds

  • Paid plans (Seed, Sapling, and Orchard) are billed in advance on a recurring basis through our payment processor, Stripe. Prices and plan limits are shown at checkout.
  • Subscriptions renew automatically until cancelled. You can cancel at any time, and cancellation takes effect at the end of your current billing period.
  • 14-day money-back guarantee on your first payment. If MyPip is not for you within 14 days of your initial purchase, contact us and we will refund that first payment in full. This applies to the initial purchase only. Renewal payments are non-refundable, so cancel before your renewal date if you do not want to be charged again.
  • We may change pricing on prospective notice. Changes apply at your next renewal.

5. Acceptable use

You agree not to:

  • use the Service, or anything it produces, to send spam or unlawful, deceptive, or harassing messages, or to break any anti-spam, marketing, or data-protection law that applies to your outreach. Depending on who you contact, this can include Canada's Anti-Spam Legislation (CASL), the EU and UK GDPR, the US CAN-SPAM Act, and similar laws elsewhere;
  • use Contacts or any contact data in a way that breaks the law or the terms of the platform the information came from;
  • reverse-engineer, scrape, overload, or disrupt the Service, or get around usage limits or security;
  • resell or provide the Service to others except as we expressly allow;
  • use the Service to build a competing product, or for any unlawful purpose.

You are solely responsible for your own outreach. MyPip prepares suggestions, but you choose who to contact and what to send. That makes you responsible for getting any consent your messages require, for identifying yourself correctly, for honouring opt-out and unsubscribe requests, and for complying with every law that applies to your contact with the people you reach.

6. Your data and your Contacts

  • Your content. You keep ownership of the content and data you give us. You grant us a licence to host and process it so we can provide and improve the Service.
  • Contacts. The Service surfaces information about potential customers from public sources and third-party providers. We do not guarantee it is accurate or complete, or that any particular person is open to being contacted. You decide how to use it, including getting any consent you need and honouring opt-out requests.
  • How we handle personal data is described in our Privacy Policy. Business users who need a data processing agreement can request one at privacy@mypip.io.

7. AI-generated output

The Service uses third-party AI models to research people, score fit, summarise context, and draft suggested messages. AI output can be wrong, incomplete, or unsuitable, so you must review it before you rely on it or send it. MyPip is not responsible for decisions you make based on AI output, and the output is not professional advice of any kind. Where you interact with our AI assistant, you are talking to an automated system, not a person.

8. Feedback

If you send us ideas or suggestions about the Service, we may use them without restriction or obligation to you, and you grant us a perpetual, royalty-free licence to do so. We will not identify you as the source without your permission.

9. Third-party services

The Service works with third parties (for example Google, Discord, Slack, Stripe, and various data providers). We are not responsible for those services, and your use of them is governed by their own terms.

10. Intellectual property

The Service, including its software, design, and content (but not your content), belongs to Toby Stapleton and our licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

11. Suspension and termination

We may suspend or end your access if you break these Terms, fail to pay, or use the Service in a way that risks harm to us, other users, or anyone else. You can stop using the Service and close your account at any time.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that Contacts or AI output will produce any particular result.

13. Limitation of liability

To the fullest extent the law allows, MyPip will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability arising out of or relating to the Service will not exceed the greater of the total fees you paid us in the 12 months before the claim, or CAD 100.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under the law that applies to you, including under British Columbia consumer-protection law.

14. Indemnity

You agree to indemnify and hold MyPip harmless from claims arising out of your use of the Service, your content or your use of Contacts, your outreach to the people you contact, or your breach of these Terms or of any law that applies to you.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version and update the "Last updated" date, and we will notify you of material changes. Continuing to use the Service after changes take effect means you accept them.

16. General

  • Governing law. These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. The courts of British Columbia have exclusive jurisdiction over any dispute.
  • Assignment. You may not assign these Terms without our consent. We may assign them in connection with a reorganisation, or a sale of the business or its assets.
  • Entire agreement. These Terms, together with the Privacy Policy and anything they refer to, are the entire agreement between you and us about the Service.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver. If we do not enforce a right, that is not a waiver of it.
  • Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
  • Notices. We may contact you by email or through the Service. You can reach us at the address below.
  • Survival. Sections that by their nature should survive (including 6, 7, 10, 12, 13, 14, and 16) survive the end of these Terms.
